ABSTRACT:
An 18 page paper discussing the European Union’s 1995 adoption and 1998 implementation of the Database Directive and the meaning of the Directive’s sui generis right. In essence, the sui generis right reinstates some of the privileges of creation and rewards for risk-taking that the basic Directive removed. The Database Directive is written from the perspective of individuals’ rights to privacy. While based on a wealth of good intentions, the Database Directive fails to adequately address the issues that the sui generis right seeks to clarify. Bibliography lists 8 sources.
