This 20 page paper provides an overview of the surviving spouse's right of election in New York State. The concept is discussed in general as well. Cases emanating from New York are cited. Several side issues, such as whether or not a gay partner is entitled to survivor benefits, and also how Medicaid fits into the picture, are also discussed. Recommendations are made.
